Abstract

Pravo na zdravstvenu zaštitu jedno je od temeljnih prava propisano Mastrihtskim Ugovorom, temeljnim dokumentom EU. Zdravstvena zaštita građana EU kompleksan je i sveobuhvatan sustav u koji se RH uključila 01. Svibnja 2013. Pristupanjem Europskoj uniji. Članstvo u Europskoj uniji Hrvatskoj je donijelo pregršt mogućnosti, ali isto tako i pregršt obveza. Jedna od tih obveza bila je prilagodba Hrvatske legislative Europskoj. Kako je zdravstvena legislativa bila samo dio velike skupine pravila i propisa isti su ostali uglavnom nezamijećeni od strane građana Republike Hrvatske. Direktiva 2011/24/EU usvojena je nekoliko mjeseci kasnije te bila puno više medijski popraćena. Cilj Direktive je regulacija jasnih i jednostavnih pravila prekogranične zdravstvene zaštite na koju građani Europske unije imaju pravo od samih početaka postojanja iste. Iako je Direktiva implementirana u Hrvatsko zakonodavstvo njena građanska implementacija ostala je uglavnom nezamijećena. Velik broj vrlo diskutabilnih pitanja ostao je otvoren ne samo za Hrvatsku već i za druga zemlje članice Europske unije. Svake tri godine od stupanja na snagu diskutira se o uspješnosti provedbe Direktive koja je za većinu zemalja članica Europske unije ostala ipak samo dokument dobre volje. Kako će teći daljnja provedbena implementacija tog dokumenta vrlo je teško pitanje na koje kvalitetan odgovor može dati samo vrijeme.

Abstract (english)

The right to health care is one of the fundamental rights laid down by the Maastricht Treaty, the main document of the European Union. Health protection of European union citizens is a complex and comprehensive system in which Croatia became a stakeholder by joining the European Union on the 1st of May 2013. Being member of the European Union has brought Croatia many opportunities but also a handful of commitments. One of these obligations was adaptation of European legislation. Knowing that the health legislation ‘’package’’ was part of a larger set of rules and regulations in generally it has not been noticed by the Croatian citizens. Directive 2011/24 / EC was adopted a few months later and received a lot more media coverage. The Directive main aims are to clarify and simplify rules of cross-border healthcare access for citizens of the European Union. Although the directive has been implemented in the Croatian legislation a civil implementation remained largely unnoticed. A large number of very questionable issues remained unanswered not only for Croatia but also for other EU countries. Every three years from the entry into force the implementation of the Directive has to be discussed. However the success of the Directive has remained largely on an voluntarily decision basis for most EU member states. Time will show if the main ideas of the Directive have been accomplished.
